Not sure about the code on that, might be able to use vented double walled steel for the chimney.

Might not have to be actual masonry but a chimney is not optional.

Well, for a real wood burning fireplace you need a masonry chimney, not just a PVC exhaust pipe like high efficiency gas burners.

My inspector even told them, the vent that's in place now is still shiny inside
